The Supreme Court of Justice ruling out the Yaakobyan family's right to repatriate.
14.03.2003 The Ministry of Foreign Affairs has confirmed its decision to deport the Armenian family. The decision followed the Supreme Court of Justice's writ ruling out the family's right to repatriate. This is despite the fact that the family's relative are confirmed Jews.
The Yaakobyan family of five is originally from Nagorniy Karabakh. For five years now, they have been desperately trying to prove that they are Jews.
The Ha`aretz informs that the Supreme Court of three has obliged the Ministry of Foreign Affairs to give the family a loan of 20,000.00 shekels and grant three months' time to prove their Jewish root on the mother's side.
The family states that it lived in Nagorniy Karabakh, near the border between Armenia and Azerbaijan. The woman is a Jew; because her mother was a Jew; however the husband is not. During the 1997 war, their house was ruined, and the Yaakobyans decided to immigrate to Israel.
The family arrived in Israel in 1997. The Ministry of Internal Affairs refused to accept the copies of the documents - the originals had been destroyed in the ruined house. The Ministry would not also consider the testimony by other family members- confirmed Jews.
The woman had damaged her eyes in the Rishon-Lezion terrorist act. Since she is not an Israeli citizen and has no rights that any Israeli citizen does, she had to go back to Nagorniy Karabakh for medical treatment.
The Ministry of Internal Affairs of Israel has not recognized as a sufficient proof the confirmation of the documents provided by the authorities of Nagorniy Karabakh.
The Rabbi Court of Tel-Aviv recognized the Jewish origin of the mother. However two months later, the same court informed that the decision was reversed. As a result, the father and daughter, a student at Tel-Aviv university, are arrested; the mother, who has to look after two under age children, is not.
